Golfeye  and its affiliates (collectively, “Golfeye”, “we”, “us” or “our”) respect your privacy and are committed to protecting it. This Privacy Policy (“Policy”) explains how we collect, use, store, share, and protect your personal information when you use the Golfeye mobile application, website, and related services (collectively, the “Golfeye App” or “Platform”).

Golfeye is designed to capture golf shots, track performance, and help users review and improve their game. This Policy applies to the products, features, and services we provide through the Golfeye App and any extensions or new features we may introduce in the future.

If a specific product, feature, or service has its own privacy policy or user agreement, that document will apply first. Where there is no separate policy, this Policy will apply.

I. How We Collect and Use Your Information

For the purposes of this Policy, “personal information” (or “personal data”) generally means any information that identifies or can reasonably be linked to an identifiable individual. The exact legal definition may vary by country or region. Local data protection laws will prevail where applicable.

We only collect personal information where it is necessary to provide our services, comply with legal obligations, improve our products, or with your consent.

1. Information We Collect from You

1.1 Account Registration and Login

To help you create and manage a Golfeye account, we may collect:

  • Login credentials (such as email address and password or phone number)

  • Third-party login information, such as tokens or identifiers, if you choose to sign in through Apple, Google, Facebook, or other supported platforms

  • Optional profile information, such as:

    • Nickname or display name

    • Profile picture

    • Gender

    • Date of birth

    • Location (city/country)

    • Short bio or profile description

If you choose to log in using a third-party account, Golfeye may receive limited information from that provider (for example, your display name, profile photo, or email address), depending on what you authorize. We do not receive your third-party passwords. Use of third-party login services is governed by those providers’ privacy policies and terms.

Refusing to provide optional profile information will not affect your ability to register and use the core features of the Golfeye App.

1.2 Golf Shot Capture and Performance Analysis

Golfeye’s primary purpose is to help you capture golf shots and analyze performance. To provide these features, we may collect:

  • Video and photo content

    • Golf swing or shot videos recorded through the Golfeye App

    • Thumbnails or still frames generated from your videos

  • Audio data

    • Audio captured together with your video (for example, swing sound or comments)

  • Shot and session metadata

    • Time and date of recording

    • Selected camera/sensor settings

    • Club information, if you manually enter it (e.g., “7 iron”, “driver”)

    • Scores, notes, and tags you choose to add (e.g., “fairway shot”, “practice session”)

We use this information to:

  • Provide recording, playback, and highlight features

  • Offer swing and shot analysis (e.g., tempo, impact frame, etc.)

  • Enable session history and performance tracking over time

  • Allow you to review and compare past shots

Your videos and content remain your content. We do not use your personal content for advertising or training models unless we obtain your explicit consent.

1.3 Sensor Data and Device Motion (Optional)

Golfeye may use device sensors (where available and enabled) to support advanced performance features. This may include:

  • Accelerometer and gyroscope data

  • Device orientation

  • Motion-related data linked to your swings

We use this data to:

  • Estimate swing metrics (e.g., tempo, backswing duration, follow-through timing)

  • Improve stability and tracking accuracy in video analysis

  • Provide better visual overlays and feedback

You may disable motion-related features in the App settings, but certain advanced analytics may no longer be available.

1.4 GPS and Activity Data (Optional)

If you allow location access, we may collect:

  • GPS location when you record shots

  • Course-related data (e.g., approximate tee or fairway location)

  • Distance, pace, route and elevation data where relevant to your game

We use this to:

  • Display shot maps and overlays

  • Help you understand shot distances and patterns

  • Provide location-based stats and insights (e.g., performance per hole or area)

You can disable location access in your device settings at any time. If you do so, Golfeye may still function, but certain GPS-based features (e.g., maps, location-based stats) may not work or may be less accurate.

1.5 In-App Tutorials, Tips, and Learning Content

Golfeye may provide:

  • Video tutorials and drills

  • Tips on swing mechanics, training plans, and practice routines

If you save, favorite, or complete specific tutorials, we may record:

  • Which tutorials you viewed

  • Which ones you saved or completed

  • Basic engagement data (e.g., completion rates)

We use this to:

  • Personalize recommended content

  • Improve our instructional material

  • Understand which resources are most useful to our users

1.6 AI-Powered Features (e.g., Swing Analysis)

Golfeye may offer AI-based features such as automatic swing identification, shot tracking, and swing comparison. When you use these features:

  • Selected videos or frames may be uploaded to our servers for processing

  • The AI model analyzes the content and returns analysis results (e.g., key frames, tempo, posture hints)

  • We may temporarily store the uploaded content for processing, caching, and improvement of your user experience

Unless we explicitly request and receive your consent, we do not use your identifiable personal content (videos, images with your face, etc.) for training our AI models.

You may choose not to use AI features and still use the basic recording features of Golfeye.

1.7 Customer Service and Feedback

When you contact Golfeye (through in-app support, email, or other channels), we may collect:

  • Your contact details (email address, username, phone number, if provided)

  • Support request content (description of the issue, attachments, screenshots, logs you choose to upload)

  • Communications history between you and Golfeye

We use this to:

  • Respond to your requests

  • Diagnose and fix technical issues

  • Improve support quality

  • Maintain records for compliance and quality assurance

1.8 Bug Reports, Logs, and Security

To ensure stability and security, we may collect:

  • Technical logs (e.g., crash logs, error reports, performance data)

  • Device information (e.g., operating system version, app version, device model)

  • Network information (e.g., IP address, connection type)

If you choose to send a bug report or “Send Logs” through the App, we may additionally collect:

  • Log files you choose to upload

  • Description of the problem (as you write it)

  • Investigate crashes, errors, or unusual behavior

  • Prevent fraud, attacks, or misuse of the platform

1.9 Marketing, Surveys, and Promotions (Optional)

  • General usage patterns (e.g., which screens you use, feature engagement)

  • Improve app performance and user experience

If you use Golfeye’s web components (e.g., a web dashboard), we may use cookies or similar technologies to:

You may manage cookie preferences in your browser settings. Disabling certain cookies may affect some website features.

II. How We Share Your Information

We do not sell your personal information.

We only share your information in the ways described below or with your explicit consent, and only when necessary to provide services, comply with the law, or protect our legitimate interests.

1. Third-Party Service Providers

We may share limited personal information with:

  • Cloud infrastructure providers (for data storage and processing)

  • Analytics providers (for usage patterns and app improvements)

4. Information You Share Publicly

Golfeye may offer features such as:

  • Shared highlight reels

If you choose to share content or information publicly or with other users, that information may be seen, collected, or used by others. You are responsible for the personal information you choose to share in public areas.

You may usually delete or modify content you have posted, but copies may remain accessible in cached or archived form, or if others have saved or shared your content.

III. Notice for Data Subjects in the EU/EEA

This section applies to you if you are located in the European Union (EU) or European Economic Area (EEA) and Golfeye processes your personal data as a controller.

1. Legal Bases for Processing

We process your personal data on one or more of the following legal bases:

  • Contract necessity: to provide the Golfeye App and fulfill our contract with you (e.g., account management, shot recording, performance analysis).

  • Legitimate interests: for security, fraud prevention, service improvement, and analytics, where these interests are not overridden by your rights.

  • Consent: for certain optional features, such as marketing communications, GPS activity tracking, advanced AI processing (where required), and certain cookies.

  • Legal obligation: to comply with applicable laws and regulations.

2. Your Rights Under GDPR

Subject to applicable law, you have the right to:

  • Rectify inaccurate or incomplete data

  • Erase your data (right to be forgotten), in certain circumstances

IV. Notice for Data Subjects in California

This section applies to California residents.

Under the California Consumer Privacy Act (CCPA) and its amendments, you may have the following rights:

  • Right to know what categories and specific pieces of personal information we collect, use, disclose, and (if applicable) sell or share

  • Right to access your personal information

  • Right to request deletion of your personal information, subject to exceptions

  • Right to correct inaccurate personal information

  • Right to opt-out of the sale or sharing of personal information (Golfeye does not sell personal information and does not share for cross-context behavioral advertising)

We may need to verify your identity before fulfilling your request. You may also designate an authorized agent to act on your behalf in accordance with CCPA.

Golfeye does not process sensitive personal information for purposes beyond those permitted under the CCPA.

V. Notice for Data Subjects in Singapore

If you are located in Singapore, this section applies in addition to the rest of this Policy.

Under the Singapore Personal Data Protection Act (PDPA), you may:

  • Access your personal data

  • Request corrections to your personal data

  • Withdraw consent to the collection, use, or disclosure of your personal data

  • Request data portability, subject to PDPA requirements

You may also apply Do Not Call (DNC) rules to telemarketing messages under Singapore law.

VI. Children’s Data

Golfeye is intended for adult users and older teenagers interested in improving their golf performance.

We define “children” as:

  • Individuals under 16 in the EU/EEA

  • Individuals under 13 in most other regions, or

  • Any person considered a “child” under local applicable law

We do not knowingly collect personal information from children. Children must not register for a Golfeye account or send us personal information unless allowed under local law and with verifiable parental or guardian consent.

If we become aware that we have collected personal data from a child without appropriate consent, we will delete such data as soon as reasonably possible.

VII. Data Retention and Security

1. Data Retention

We will retain your personal information only for as long as necessary to:

  • Provide the Golfeye services

  • Fulfill the purposes described in this Policy

  • Comply with legal, regulatory, or accounting requirements

  • Resolve disputes and enforce our agreements

If we terminate certain services or the Golfeye App:

  • We will stop collecting new personal information related to those services

  • We will delete or anonymize personal information associated with those services, unless laws require us to retain it for a longer period

Once data is anonymized (i.e., no longer associated with an identifiable individual), we may use it for statistical or analytical purposes indefinitely without further notice.

2. Account Cancellation

You may cancel your Golfeye account through the App:

Golfeye App → Profile → Settings → Delete Account

After account deletion:

  • We will stop providing services tied to the account

  • We will delete or anonymize your personal information, unless retention is required by law (for example, records related to security or legal obligations)

Some content may remain in backup archives for a limited period. In such cases, we will store it securely and isolate it from active processing until deletion is possible.

3. Data Security

We implement reasonable and appropriate technical and organizational measures to protect personal data, including:

  • Encryption of data in transit (e.g., HTTPS/SSL) and, where appropriate, at rest

  • Access controls and authentication measures

  • Network and application-level security protections

  • Regular security assessments and audits

  • Internal policies and training to promote data protection

Despite our efforts, no system can be guaranteed 100% secure. If a security incident occurs that affects your personal information, we will:

  • Act in accordance with applicable law

  • Take appropriate remediation steps
